This applies in particular to the dispute whether a genocide is occurring. Apart from the legal assessment currently being made by the International Court of Justice, a parallel, polemical discussion about the concept of genocide distracts from actual priorities for action. The war has already cost tens of thousands of lives, and many more Palestinians will die as a direct and indirect consequence of the war. The mass violence against civilians and the destruction of <\/strong><strong>conditions of life in Gaza must end immediately \u2013 regardless of whether the legal conditions for genocide are met. <\/strong><\/p>\n<p>Five months after the Hamas attacks of 7 October 2023 and their ongoing seizure of hostages and the subsequent Israeli military offensive in the Gaza Strip, the structures of the German war<a href=\"https:\/\/blog.prif.org\/2023\/12\/07\/israel-gaza-a-german-war-discourse\/\" target=\"_blank\" rel=\"noopener\"> discourse<\/a> make it difficult to find an appropriate language to discuss violations of international law and war crimes committed by all parties. The accusation of genocide is particularly politically explosive in this context \u2013 especially when it is levelled against Israel and when it is made in Germany.<\/p>\n<p>Various traditional <a href=\"https:\/\/doi.org\/10.1080\/14623528.2024.2309709\" target=\"_blank\" rel=\"noopener\">motifs of exceptionalism<\/a> overlap here: the Holocaust as the archetype of genocide, which cannot <a href=\"https:\/\/www.zeit.de\/2021\/14\/erinnerungskultur-gedenken-pluralisieren-holocaust-vergleich-globalisierung-geschichte\" target=\"_blank\" rel=\"noopener\">be compared<\/a> with other types of violence; German guilt, from which a special obligation to defend Israel as a <a href=\"https:\/\/www1.wdr.de\/kultur\/kulturnachrichten\/habeck-friedman-antisemitismus-judenhass-israel-100.html\" target=\"_blank\" rel=\"noopener\">\u201csafe place for Jews\u201d <\/a>is derived.<\/p>\n<p><a href=\"https:\/\/www.spiegel.de\/geschichte\/gaza-israel-krieg-wie-juristen-und-historiker-genozid-vorwuerfe-einordnen-a-aa0f9ae2-7eae-481f-84df-a51db77af91e\" target=\"_blank\" rel=\"noopener\">In German discourse,<\/a> the possibility of genocide by the Israeli state is sometimes <a href=\"https:\/\/www.bundesregierung.de\/breg-de\/aktuelles\/erklaerung-der-bundesregierung-zur-verhandlung-am-internationalen-gerichtshof-2252842\" target=\"_blank\" rel=\"noopener\">categorically ruled out<\/a>, sometimes dismissed with a reference to the <a href=\"https:\/\/www.sueddeutsche.de\/meinung\/israel-hamas-gaza-genozid-voelkermord-1.6316460\" target=\"_blank\" rel=\"noopener\">genocidal features of the Hamas attacks<\/a>. Sometimes the accusation of genocide also provokes a kind of \u201c<a href=\"https:\/\/taz.de\/Israels-Krieg-in-Gaza\/!5981361\/\" target=\"_blank\" rel=\"noopener\">loud silence<\/a>\u201d \u2013 be it as a strategy to silence what must not be, as an expression of unease in the context of <a href=\"https:\/\/www.boell.de\/de\/2024\/01\/02\/keine-loesung-ist-auch-keine-loesung\" target=\"_blank\" rel=\"noopener\">Germany&#8217;s historical guilt<\/a>, out of a perceived lack of judgement in relation to an impenetrable conflict or out of the fear of saying the wrong thing on this controversial issue.<\/p>\n<p>As in <a href=\"https:\/\/www.spiegel.de\/ausland\/deutsche-israel-politik-verpanzerte-herzen-a-80ca16fd-0845-405d-bf89-d157bbabbbb3?sara_ref=re-so-app-sh\" target=\"_blank\" rel=\"noopener\">previous debates<\/a>, it is urged from the <a href=\"https:\/\/www.theguardian.com\/world\/2023\/nov\/22\/the-principle-of-human-dignity-must-apply-to-all-people\" target=\"_blank\" rel=\"noopener\">outside<\/a> and very rarely <a href=\"https:\/\/qantara.de\/artikel\/interview-mit-dem-historiker-j%C3%BCrgen-zimmerer-es-braucht-einen-aufstand-der-anst%C3%A4ndigen%E2%80%9C\" target=\"_blank\" rel=\"noopener\">from within<\/a> Germany that the lessons of German history be understood and applied in their <a href=\"https:\/\/blog.prif.org\/2023\/12\/21\/israels-sicherheit-und-die-deutsche-staatsraeson\/\" target=\"_blank\" rel=\"noopener\">universality<\/a>. The German <a href=\"https:\/\/taz.de\/Deutsche-Haltung-im-Nahostkonflikt\/!5968113\/\" target=\"_blank\" rel=\"noopener\">\u201cNever again!\u201d<\/a> should be directed against the worst forms of violence, no matter who the perpetrators or the victims. However, when demands of \u201cStop the genocide in Gaza!\u201d are made at <a href=\"https:\/\/www.zeit.de\/gesellschaft\/zeitgeschehen\/2023-11\/demo-berlin-duesseldorf-palaestina-israel\" target=\"_blank\" rel=\"noopener\">demonstrations<\/a> or <a href=\"https:\/\/www.tagesschau.de\/inland\/regional\/berlin\/rbb-politik-wertet-israel-kritik-bei-preisverleihung-als-schaden-fuer-die-berlinale-100.html\" target=\"_blank\" rel=\"noopener\">major cultural events<\/a> in Germany, accusations of anti-Semitism are quickly levelled.<\/p>\n<p>In such cases, the use of the term \u201cgenocide\u201d triggers <a href=\"https:\/\/qantara.de\/artikel\/die-deutsche-wissenschaft-und-der-gaza-krieg-universit%C3%A4ten-m%C3%BCssen-r%C3%A4ume-f%C3%BCr-den-dialog\" target=\"_blank\" rel=\"noopener\">a polarisation into two camps<\/a> and functions as a conversation stopper. But as genocide is considered the \u201ccrime of crimes\u201d or ultimate evil, the <a href=\"https:\/\/www.zeit.de\/politik\/2024-02\/genozid-vorwurf-igh-israel-justiz\" target=\"_blank\" rel=\"noopener\">incentives<\/a> to prove its existence \u2013 or to deny it \u2013 are high.<\/p>\n<h2>What Sets Genocide Apart: The Genocidal Intention<\/h2>\n<p>There is also a lot at stake because, unlike other acts of violence, ascertaining genocide legally entails <a href=\"https:\/\/www.un.org\/en\/genocideprevention\/documents\/atrocity-crimes\/Doc.1_Convention%20on%20the%20Prevention%20and%20Punishment%20of%20the%20Crime%20of%20Genocide.pdf\" target=\"_blank\" rel=\"noopener\">intervention<\/a> by the international community. On this basis, South Africa has filed a lawsuit against Israel for genocide at the International Court of Justice (ICJ) in The Hague. The ICJ has since ordered <a href=\"https:\/\/www.icj-cij.org\/node\/203454\" target=\"_blank\" rel=\"noopener\">six interim measures<\/a> to be taken by Israel to prevent a possible genocide, which it has so far <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2024\/02\/israel-defying-icj-ruling-to-prevent-genocide-by-failing-to-allow-adequate-humanitarian-aid-to-reach-gaza\/\" target=\"_blank\" rel=\"noopener\">implemented only inadequately<\/a>.<\/p>\n<p>The <a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/convention-prevention-and-punishment-crime-genocide\" target=\"_blank\" rel=\"noopener\">United Nations Convention<\/a> on genocide defines it as an act \u201ccommitted with intent to destroy, in whole or in part, a national, ethnical, racial or religious group as such\u201d. Such destruction can take place not only through the active killing of a group, but also through causing physical and psychological harm or inflicting \u201cconditions of life calculated to bring about its physical destruction in whole or in part\u201d, among other things. The key distinguishing feature from crimes against humanity or war crimes is the intention to destroy a group. At the same time, it is precisely this characteristic of the violence that is most difficult to prove.<\/p>\n<p>Whether Israeli warfare <a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/192\/192-20231228-app-01-00-en.pdf\" target=\"_blank\" rel=\"noopener\">constitutes genocide<\/a> therefore depends largely on the assessment of genocidal intent. Accordingly, the <a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/192\/192-20231228-app-01-00-en.pdf\" target=\"_blank\" rel=\"noopener\">South African lawsuit<\/a> focused on statements made by high-ranking members of the Israeli government in order to infer an intention to destroy \u2013 such as the Israeli prime minister&#8217;s call to his people not to forget what the <a href=\"https:\/\/taz.de\/Benjamin-Netanjahus-Kriegsrhetorik\/!5964144\/\" target=\"_blank\" rel=\"noopener\">Amalekites had done to them<\/a>. According to holy scripture, God called on the Israelites to exterminate this people. And <a href=\"https:\/\/www.timesofisrael.com\/pms-office-says-its-preposterous-to-say-invoking-amalek-was-a-genocide-call\/\" target=\"_blank\" rel=\"noopener\">even if Netanyahu has denied<\/a> that he was expressing a genocidal intention towards the Palestinians, such and similar statements are <a href=\"https:\/\/law4palestine.org\/law-for-palestine-releases-database-with-500-instances-of-israeli-incitement-to-genocide-continuously-updated\/\" target=\"_blank\" rel=\"noopener\">no exception<\/a> among Israeli political decision-makers and military leaders. The ICJ ruled that the Israeli state must take measures to prevent and punish direct and public incitement to genocide.<\/p>\n<p>The court will continue to investigate whether genocidal intent exists on a collective level. However, this investigation may take years. Nevertheless, the term remains the focal point of broad debates in Germany (and elsewhere) \u2013 as if it were the only way to determine once and for all whether Israel&#8217;s mass violence against <a href=\"https:\/\/www.zeit.de\/politik\/2024-02\/genozid-vorwurf-igh-israel-justiz\" target=\"_blank\" rel=\"noopener\">civilians is illegitimate or not<\/a>.<\/p>\n<h2>Mass Violence Beyond the Question of Intent: Transgressive Discourse and Escalation of Violence<\/h2>\n<p>Research on mass violence beyond genocide also points to mechanisms through which <a href=\"https:\/\/global.oup.com\/academic\/product\/ideology-and-mass-killing-9780198776796?facet_narrowbypubdate_facet=Next%203%20months&amp;lang=en&amp;cc=au\" target=\"_blank\" rel=\"noopener\">discursive transgression<\/a> also translates into an escalation of violence. We also observe such an escalation in the war in Gaza. Here, while the distinction between combatants and non-combatants is central to international humanitarian law, messy <a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/14623528.2020.1756558\" target=\"_blank\" rel=\"noopener\">contexts of war<\/a> are susceptible to undermining this guaranteed protection of non-combatant civilians. One example of such discursive and military escalation is the statement by Israeli President Isaac Herzog at the beginning of the war that there were <a href=\"https:\/\/www.huffpost.com\/entry\/israel-gaza-isaac-herzog_n_65295ee8e4b03ea0c004e2a8\" target=\"_blank\" rel=\"noopener\">no innocent civilians in Gaza<\/a>.<\/p>\n<p>Discursive transgressions operate with <a href=\"https:\/\/www.cambridge.org\/core\/books\/problems-of-genocide\/1C48C9BAE4A2CA4EA6727F19771651A6\" target=\"_blank\" rel=\"noopener\">collectivising attributions<\/a>. Entire groups of people are labelled as \u201c<a href=\"https:\/\/www.cambridge.org\/core\/books\/problems-of-genocide\/1C48C9BAE4A2CA4EA6727F19771651A6\" target=\"_blank\" rel=\"noopener\">dangerous<\/a>\u201d or \u201cguilty\u201d and stylised as a security threat. Sometimes this kind of rhetorical escalation ends in the <a href=\"https:\/\/digitalcommons.usf.edu\/gsp\/vol7\/iss2\/7\/\" target=\"_blank\" rel=\"noopener\">denial of humanity<\/a>. For example, the Israeli defence minister described Palestinians as <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2023\/nov\/13\/palestinians-world-israel-carnage-gaza\" target=\"_blank\" rel=\"noopener\">\u201chuman animals\u201d<\/a>. Such dehumanisation, <a href=\"https:\/\/www.jstor.org\/stable\/25472566\" target=\"_blank\" rel=\"noopener\">current research argues<\/a>, also contributes to viewing the destruction of a group as legitimate \u2013 or at least to accepting the mass killing of its members.<\/p>\n<p>Given the extent of the violence in Gaza, it can be assumed that the discursive transgressions have also contributed to the escalation of violence against the civilian population. Though statistics cannot grasp the significance of individual life lost, the scale of violence is overwhelming \u2013 also in relation to other <a href=\"https:\/\/watson.brown.edu\/costsofwar\/costs\/human\" target=\"_blank\" rel=\"noopener\">wars in the name of militarily combatting terrorism<\/a>. In the past five months, Israeli military operations in Gaza have <a href=\"https:\/\/www.ochaopt.org\/\" target=\"_blank\" rel=\"noopener\">killed over 30,000 people<\/a>, around 1.4% of the population.<\/p>\n<p>Since the beginning of the war, <a href=\"https:\/\/www.haaretz.com\/israel-news\/2023-12-09\/ty-article-magazine\/.highlight\/the-israeli-army-has-dropped-the-restraint-in-gaza-and-data-shows-unprecedented-killing\/0000018c-4cca-db23-ad9f-6cdae8ad0000\" target=\"_blank\" rel=\"noopener\">more than 60%<\/a> of Palestinians killed have been <a href=\"https:\/\/www.haaretz.com\/israel-news\/2023-12-09\/ty-article-magazine\/.highlight\/the-israeli-army-has-dropped-the-restraint-in-gaza-and-data-shows-unprecedented-killing\/0000018c-4cca-db23-ad9f-6cdae8ad0000\" target=\"_blank\" rel=\"noopener\">civilians<\/a>; some estimates put the figure <a href=\"https:\/\/www.nytimes.com\/2023\/11\/25\/world\/middleeast\/israel-gaza-death-toll.html\" target=\"_blank\" rel=\"noopener\">as high as 70%<\/a>. The numbers provided by the Ministry of Health in Gaza are regularly <a href=\"https:\/\/www.reuters.com\/world\/middle-east\/despite-bidens-doubts-humanitarian-agencies-consider-gaza-toll-reliable-2023-10-27\/\" target=\"_blank\" rel=\"noopener\">questioned<\/a> as it has been run by Hamas since taking power in 2007. However, the ministry&#8217;s statistics have proven <a href=\"https:\/\/www.theguardian.com\/world\/2023\/oct\/26\/can-we-trust-casualty-figures-from-the-hamas-run-gaza-health-ministry\" target=\"_blank\" rel=\"noopener\">reliable<\/a> in the past. The ratio of 2 civilian casualties for every 1 combatant killed also corresponds to the official information provided by the Israeli military that even deems this <a href=\"https:\/\/www.theguardian.com\/world\/2024\/jan\/08\/the-numbers-that-reveal-the-extent-of-the-destruction-in-gaza\" target=\"_blank\" rel=\"noopener\">\u201ctremendously positive\u201d<\/a>.<\/p>\n<h2>Deprivation of Basic Necessities of Life and Indirect Consequences of War<\/h2>\n<p>The dead from this war are far from being counted, even if a ceasefire came into effect immediately. Inflicting <a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/14623528.2024.2310866?src=exp-la\" target=\"_blank\" rel=\"noopener\">catastrophic conditions of life<\/a> leads to certain mass death of civilians beyond direct combat operations. Studies on the \u201cglobal war on terror\u201d have found that <a href=\"https:\/\/watson.brown.edu\/costsofwar\/files\/cow\/imce\/papers\/2023\/Indirect%20Deaths.pdf\" target=\"_blank\" rel=\"noopener\">80% of deaths were caused by such indirect consequences of war<\/a>. Israel\u2019s war in Gaza has created conditions that are inhospitable to life.<\/p>\n<p>Over <a href=\"https:\/\/press.un.org\/en\/2024\/sc15564.doc.htm\" target=\"_blank\" rel=\"noopener\">85% of the population<\/a> have already been displaced from their homes due to the fighting. In January 2024, more than 60% of buildings in Gaza had been severely damaged or <a href=\"https:\/\/www.bbc.com\/news\/world-middle-east-68006607\" target=\"_blank\" rel=\"noopener\">destroyed<\/a>. Also, the general infrastructure has been affected by the deadly destruction, undermining the economic basis of existence, food supplies, public administration, education, basic medical care \u2013 none of these can be guaranteed any longer.<\/p>\n<p>More than 73,000 inhabitants of the Gaza Strip have been <a href=\"https:\/\/www.ochaopt.org\/\" target=\"_blank\" rel=\"noopener\">wounded<\/a> and it is almost impossible to treat them given the <a href=\"https:\/\/www.aerzte-ohne-grenzen.de\/unsere-arbeit\/einsatzlaender\/palaestinensische-autonomiegebiete\" target=\"_blank\" rel=\"noopener\">collapsed healthcare system<\/a>, destroyed hospitals and the lack of medicines and materials. Elderly people, women and children are disproportionately affected by these consequences. Serious complications arise during pregnancies and in the care of new-born babies and their mothers.<\/p>\n<p>Because Israel regularly prevents the already difficult delivery of aid to the combat zone, there is a shortage of water, fuel and food. <a href=\"https:\/\/www.who.int\/news\/item\/21-12-2023-lethal-combination-of-hunger-and-disease-to-lead-to-more-deaths-in-gaza\" target=\"_blank\" rel=\"noopener\">93% of the people are starving<\/a>. The extreme restrictions on aid supplies, which even briefly worsened after the ICJ judgement, are now seen <a href=\"https:\/\/www.bbc.com\/news\/world-middle-east-68550937\" target=\"_blank\" rel=\"noopener\">by the EU<\/a> as <a href=\"https:\/\/www.ipg-journal.de\/regionen\/naher-osten\/artikel\/hunger-als-kriegswaffe-7377\/\" target=\"_blank\" rel=\"noopener\">the use of starvation as a weapon of war.<\/a><\/p>\n<h2>In Favour of an Immediate End to the Violence and Direct, Massive Humanitarian Aid<\/h2>\n<p>We assert: far too many innocent women, children and men in Gaza have already died as a result of fighting, and we fear a massive increase in the number of deaths due to further escalations of violence and hostile conditions of life in Gaza.<\/p>\n<p>Whether the ICJ will categorise the Israeli violence as genocide cannot be answered now. And yet it is also irrelevant for a forceful discursive, diplomatic and political commitment to an immediate ceasefire and for the implementation of direct and massive humanitarian aid.<\/p>\n<p>The German government \u2013 together with its allies \u2013 must focus all its efforts and levy its entire political weight to put an immediate end to the massive violence against civilians and the withdrawal of life essentials in Gaza.
